Legal Separation - Actions for the support for married persons living apart.

The purpose of M.G.L. c. 209, §32F is to make it easier to obtain spousal and child support without the need for divorce, annulment, or protective orders.  Under the law:

(a) the State may file a complaint for parental reimbursement of public assistance paid for a child;

(b) a married parent may file a complaint seeking support for a dependent child in their care;

(c) a married person who is living apart from their spouse may file a complaint seeking separate spousal support; and,
 
(d) a guardian, next-of-kin, or other person who is providing care for a child and has physical custody of the child may file an action to obtain support from the parent or parents.

It is important to realize that the couple who obtains a legal separation remains legally married.
